The complainants alleged that DHS unlawfully changed asylum rules, thereby limiting eligibility for asylum, making it more difficult to meet the definition of a refugee, qualify for an asylum test, and then qualify for asylum. The plaintiffs argued that such changes would thwart their organizational tasks and divert resources from litigation. Represented by Sidley Austin, the Harvard Immigration and Refugee Clinical Program and the Hastings Center for Gender and Refugee Studies at the University of California, the plaintiffs sought attorneys` fees and a permanent injunction to prevent implementation of the amended rules.
