How often do the magistrates of this department issue R&R and on what subjects? To answer this question, we searched the Norfolk and Newport News Division`s waybills for civil cases filed in 2019. When we searched for “report and recommendation” and “report and recommendations,” we identified 118 waybills that contained this term. Of these, the “Type of complaint” entry indicated that 23 were social security complaints and 80 were described as actions of prisoners. The departments of Norfolk and Newport News are fortunate to have three experienced and competent judges. The position of Magistrate Judge was created by law in 1968 – specifically, the position was created in 1968, but the title of Magistrate Judge comes from the Judicial Improvements Act 1990. Federal Rule of Civil Procedure 72 contains similar wording. These proposed results are often referred to as a report and recommendation (“R&R”). Only 15 other civil cases contained a journal entry for a report and recommendation. What types of requests have been transferred for R&R? And how many times have objections been raised against R&R results? And did an objection ever come to fruition? Regardless of which judge in the Division is considering a determinative issue, the parties to that Division receive a reasoned decision. But R&R by magistrate judges is relatively rare in the department, and a successful appeal against an R&R is even rarer. But perhaps the most interesting aspect of the 14 cases in which an R&R has been issued is the identity of the referring district judge. In all cases reviewed, the Honourable Rebecca Beach Smith was the presiding judge. This has not always been the case in recent years[4], but it is surprising for this series of cases in 2019.
